Terms of Service

By accessing or using BookFade ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users of the Service, including barbers, barbershop owners, and clients who book appointments.

BookFade is an online booking platform designed for barbers and barbershops. The Service allows barbers to create booking pages, manage appointments, and communicate with clients. Clients can use the Service to book appointments with participating barbers.

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

Subscription Plans

BookFade offers paid subscription plans with different features and pricing. Details of current plans are available on our pricing page.

Free Trial

New accounts receive a free trial period. Web subscriptions include a 14-day free trial, and App Store subscriptions include a 14-day free trial. Your payment method will be charged automatically when the trial ends unless you cancel before the trial period expires.

Auto-Renewal

Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel your subscriptions by going to your account settings on the App Store or through your BookFade account settings on the web.

Billing

Subscriptions are billed in advance on a monthly or yearly basis. All fees are non-refundable except as expressly stated in these Terms.

Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing period. You will continue to have access to the Service until then.

One Subscription Per Physical Location

Each Shop Plan subscription is valid for one (1) physical barbershop location only and includes up to five (5) barbers. All barbers must work at that specific physical location and be employed by or contracted with that barbershop. If you need more than 5 barbers, please contact us at [email protected] with verification that the additional barbers work at your location.

Prohibited Uses

The following uses of the Shop Plan are strictly prohibited:

• Adding barbers who do not physically work at your barbershop location
• Sharing one subscription across multiple barbershop locations
• Reselling or sublicensing access to barbers at other businesses
• Creating accounts for barbers who operate independently at different locations
• Using a Shop Plan as a "collective" for unrelated independent barbers

Multiple Locations

If you own or operate multiple barbershop locations, each location requires its own separate Shop Plan subscription.

Enforcement

We reserve the right to audit Shop Plan accounts to ensure compliance. If we determine that a Shop Plan is being used in violation of this policy, we will immediately terminate the account and all associated barber accounts without refund. Repeated violations may result in permanent bans from the BookFade platform.

You agree not to:

• Use the Service for any unlawful purpose
• Impersonate any person or entity
• Interfere with the operation of the Service
• Attempt to gain unauthorized access to any systems
• Upload malicious code or content
• Harvest or collect user information without consent
• Use the Service to send spam or unsolicited messages

You retain ownership of content you submit to BookFade. By submitting content, you grant us a license to use, display, and distribute that content in connection with the Service.

You are responsible for all content you submit and represent that you have the right to share such content.

The Service and its original content, features, and functionality are owned by Vaylo Studios and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

The Service may integrate with third-party services (such as payment processors and communication providers). Your use of these services is subject to their respective terms and policies.

You agree to indemnify and hold harmless Vaylo Studios and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

We may terminate or suspend your account at any time for violations of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease.

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on this page. Continued use of the Service after changes constitutes acceptance of the new Terms.

These Terms shall be governed by the laws of the State of Delaware, without regard to conflict of law principles.
